ProSticks' products, services, and data (collectively "Offerings") are provided by ProSticks Financial Solutions Ltd. ("ProSticks"), and your use of the Offerings, or any of them, constitutes your acceptance of this User Agreement and is subject to it.

You may use the Offerings only for your personal use. You may not publish, retransmit, redistribute or otherwise reproduce the Offerings, including but not limited to the underlying data, in any form, to anyone, whether or not you accept compensation for doing so. You may save data and charts to your hard drive or other storage media, and you may print data and charts out onto paper, and manipulate them in any way you like, provided that you do so for your own use, and do not distribute the charts or data to others.

ProSticks reserves the right to change the terms, conditions, and notices under which this website and the Offerings are made available.

You may not copy or modify ProSticks' Java applets or other software, except as necessary for your personal use of the software consistent with this agreement.

ProSticks makes reasonable efforts to ensure that the information made available through the Offerings is accurate and up-to-date. Mistakes and accidents do happen, though, so before trading, you should confirm the accuracy and timeliness of information you receive through any ProSticks Offerings against that provided by another source.

As a condition of using any ProSticks Offerings, you agree that ProSticks will not be liable for any damages whatsoever (including but not limited to lost profits, trading losses and damages) that result from inconvenience, delay or loss of the use of the Offerings, or inaccuracy of the information provided through or comprising an Offerings, even if ProSticks has been advised of the possibility of such damages, and regardless whether the claim for such damages is based in contract, tort, indemnity, or some combination, or otherwise.

ProSticks makes no express or implied warranties (including, without limitation, any warranty of merchantability or fitness for a particular purpose or use) regarding information provided through or comprising any ProSticks Offerings. All Offerings, including but not limited to the data, are provided to you "as is." Although they are obtained from sources believed to be reliable, they are not guaranteed.

This User Agreement will be governed and construed in accordance with the laws of the province of British Columbia, Canada, without regard to its conflicts of laws provisions or those of any other jurisdiction, and by using ProSticks' Offerings, or any of them, you agree that any litigation or other dispute arising out of or relating to this User Agreement or ProSticks Offerings shall be brought exclusively in the courts located in British Columbia, Canada, and that you consent to the personal jurisdiction of, and venue in, such courts. In the event of any dispute arising out of the subject matter of, or to enforce, this User Agreement, the prevailing party shall recover, in addition to any other damages assessed, its reasonable expenses, including attorneys' fees and costs, incurred in resolving such dispute.

All information provided by DTN Market Access and World Wide Quote. ("The DTN and WWQuote Information") is owned by or licensed to DTN and WWQuote and its affiliates and any user is permitted to store, manipulate, analyze, reformat, print and display the DTN and WWQuote Information only for such user's personal use. In no event shall any user publish, retransmit, redistribute or otherwise reproduce any DTN and WWQuote Information in any format to anyone, and no user shall use any DTN and WWQuote Information in or in connection with any business or commercial enterprise, including, without limitation, any securities, investment, accounting, banking, legal or media business or enterprise.

Prior to the execution of a security trade based upon the DTN and WWQuote Information, you are advised to consult with your broker or other financial representative to verify pricing information.

THE DTN AND WWQUOTE INFORMATION IS PROVIDED TO THE USERS "AS IS." NEITHER DTN AND WWQUOTE NOR ITS AFFILIATES MAKE ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND REGARDING THE DTN AND WWQUOTE INFORMATION, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE. NEITHER DTN AND WWQUOTE NOR ITS AFFILIATES WILL BE LIABLE TO ANY USER OR ANYONE ELSE FOR ANY INTERRUPTION, INACCURACY, ERROR OR OMISSION, REGARDLESS OF CAUSE, IN THE DTN AND WWQUOTE INFORMATION OR FOR ANY DAMAGES (WHETHER DIRECT OR INDIRECT, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY) RESULTING THEREFROM.

Neither ProSticks nor any ProSticks Offerings is an investment, legal, or tax advisor, and none of the information available through ProSticks Offerings is intended to provide tax, legal or investment advice.

Nothing provided through any ProSticks Offerings constitutes a solicitation by ProSticks of the purchase or sale of securities.

As your agreement for the receipt and use of market data provides, the securities markets (1) reserve all rights to the market data that they make available; (2) do not guarantee that data; and (3) shall not be liable for any loss due either to their negligence or to any cause beyond their reasonable control. ProSticks Financial Solutions Ltd., DTN Market Access, World Wide Quote, American Stock Exchange, Chicago Mercantile Exchange, Dow Jones Indexes, New York Stock Exchange, NASDAQ Stock Market, and TSX Group endeavor to ensure the accuracy and reliability of the information provided but do not guarantee its accuracy or reliability and accept no liability (whether in tort or contract or otherwise) for any loss or damage arising from any inaccuracies or omission.
